July 10 - Like something out of a B-grade horror movie, a woman who was the
victim of a serial rapist in the United Kingdom, has been given the right to sue
her attacker for his money after he won millions of pounds in the UK National
Lottery while in prison.
Yesterday in a London court, a judge granted the right of the attempted rape
victim, a 78-year-old pensioner called 'Mrs A' to sue her attacker, Iorworth
Hoare, for punitive damages. These damages could be quite hefty after Hoare won
7 million pounds in 2004.
It seems that during a supervised excursion, Hoare went into a newsagent where
he bought the lucky lottery ticket. However, Hoare could only claim his winnings
upon his release from prison in 2005, after serving 16 years of a life sentence
he received for attacking Mrs A in 1989.
Hoare went to prison with six previous convictions for sexual assaults and rape.
When Mrs A found out that Hoare had won a UK National Lottery jackpot,
she decided to sue him. However, she was told that this was impossible as the
compensation claims time limit of 6 years had expired.
So she went to court and was awarded the right to sue Hoare. The judge accepted
that when Mrs A had the opportunity to sue the attacker soon after her ordeal,
as a 'broke' convict, it would not have made financial sense. Obviously after
winning a UK National Lottery jackpot, it became feasible.
Testified Mrs A in court, 'I very strongly believe he should be held accountable
to me for his attack on me as well as the physiological damage the attack caused
me over the years. The attack fundamentally changed me and I am not the person I
used to be.'
